An applicant for a mortgage loan originator license must pay an investigation fee of $250 and an NMLS processing fee of $30, through NMLS, at the time of application. If the application is approved the applicant pays a licensing fee of $250 directly to the Office of the State Bank Commissioner (not through NMLS). The licensing fee is required again at the next renewal (filed through NMLS during the month of November) and annually at each renewal thereafter, but at renewal the licensing fee is collected by NMLS. A $500 supervisory assessment fee will be billed directly by the Office of the State Bank Commissioner each July, which is due no later than August 1st. NMLS charges an annual processing fee on a per license/per state basis. The processing fee pays for the operation of NMLS including access to the licensee system; creation, maintenance and production of reports and call center operation.

An individual who meets the definition of a mortgage loan originator or otherwise falls under the authority of the Delaware SAFE Act, and is employed by a licensed lender, mortgage loan broker, independent processor or manufactured housing finance company, must submit a license application to Delaware, through NMLS, before conducting Delaware business under the Act.

Mortgage loan originators must complete the NMLS form called MU4 (uniform individual mortgage licensing/registration and consent form). It may be completed and submitted by the individual, or the employing company may complete and submit the form provided the individual logs in and attests to its accuracy. Once an individual submits the MU4 the first time, he/she does not have to re-enter the entire record each time he/she applies to a new state. The NMLS Licensing Wizard will forward the information each time an individual applies.

  • If an applicant answers “yes” to any disclosure question the applicant must provide a written explanation of the response and copies of any pertinent documents. This may be uploaded into NMLS.
  • Documentation that the applicant is covered by a surety bond, either from the applicant or through the employer.
  • NMLS must indicate the applicant has given consent to having their credit report pulled by the NMLS credit report function.
  • NMLS must indicate the applicant has submitted fingerprints and given consent for a criminal background check.
  • NMLS must indicate the applicant has completed 20 hours of NMLS pre-licensure education, and is current on continuing education requirements, if applicable.
  • NMLS must indicate the applicant has taken and passed both the National and Delaware State components of the SAFE Test, or
  • NMLS must indicate the applicant has taken and passed both the National and Stand-alone UST components of the SAFE Test, or
  • NMLS must indicate the applicant has taken and passed the SAFE MLO National Test Component with Uniform State Content.

Renewal of mortgage loan originator licenses is through NMLS beginning November 1st each year. Applications to renew Delaware mortgage loan originator licenses must be submitted to NMLS no later than December 1st each year.

Each year the renewal requirements of individual states are updated and posted on NMLS prior to renewal time. Often, a licensee who had to provide an explanation of an affirmative response to a disclosure question on the initial application will have to provide an update of the situation at renewal, especially if the issue was related to the financial responsibility of the licensee.

All entities holding a Mortgage License in Arizona must submit a renewal request through NMLS between the established renewal dates.  You may submit a renewal request up to 30 days after the end of the regular renewal period, but there will be a late fee assessed of $25.00 per day depending on your license type.  The NMLS streamlined renewal process allows you to conveniently manage the renewal of your company and branch licenses through your entity’s NMLS account.  Specific renewal dates and information for each license type is set forth below:

Mortgage Broker,  Commercial Mortgage Broker:

A licensee shall pay the renewal fee on or before December 31 of each year. Licenses not renewed by December 31 are suspended, and the licensee shall not act as a mortgage broker or a commercial mortgage broker until the license is renewed or a new license is issued pursuant to this article. A person may renew a suspended license by paying the renewal fee plus twenty-five dollars for each day after December 31 that a license renewal fee is not received by the superintendent and applying for renewal as prescribed by the superintendent. A license that is not renewed by January 31 expires. A license shall not be granted to the holder of an expired license except as provided in this article for the issuance of an original license. 

Mortgage Banker:

A licensee shall pay the renewal fee on or before December 31. Licenses not renewed by December 31 are suspended, and the licensee shall not act as a mortgage banker until the license is renewed or a new license is issued pursuant to this article. A person may renew a suspended license by paying the renewal fee plus twenty-five dollars for each day after December 31 that a license renewal fee is not received by the superintendent and applying for renewal as prescribed by the superintendent. Licenses that are not renewed by January 31 expire. A license shall not be granted to the holder of an expired license except as provided in this article for the issuance of an original license.

Commercial Mortgage Banker:

If a license is not renewed by December 31 of each year, the license is suspended. The licensee shall not act as a commercial mortgage banker until the license is renewed or a new license is issued pursuant to this article.  A person may renew a suspended license by applying for renewal as prescribed by the superintendent.  Licenses that are not renewed by January 31 expire. A license shall not be granted to the holder of an expired license except as provided in this article for issuing an original license.

Registered Exempt Person:

A person shall make an application for renewal of a certificate of exemption in writing on the forms, in the manner and accompanied by the information prescribed by the superintendent. The superintendent may require additional information on the experience, background, honesty, truthfulness, integrity and competency of the applicant and the responsible individual designated by the applicant.  Renewal must be made to the Department by December 31 of each year.

Loan Originator:

A person shall make an application for renewal of a license in writing in the manner prescribed by the superintendent and accompanied by the information prescribed by the superintendent.  Before submitting a renewal application, an applicant for renewal of a loan originator license shall have satisfactorily completed eight approved continuing education units that include at least:

  1.  Three hours of federal law.
  2. Two hours of ethics, including instruction on fraud, consumer protection and fair lending issues.
  3. Two hours of training related to lending standards for the nontraditional mortgage product marketplace.
  4. One hour of Arizona law.

What is the required reinstatement fee if an MLO fails to renew their license on time in NC?

NMLS requires a $30 processing fee for each MLO seeking to renew or reactivate a registration. MLOs who are submitted for renewal but did not complete renewal attestation prior to December 31 need to be reactivated, incurring an additional $30 processing fee at the time of reactivation.
